Prenuptial Agreements Can Help Establish a Strong Partnership
Establishing a strong partnership is important in any relationship, including marriage. One way to do this is through the use of prenuptial agreements. These agreements can help couples work out their finances and protect their assets in the event of a divorce. By discussing their finances and coming to an agreement beforehand, couples can establish a strong foundation for their marriage.
Another important aspect of divorce, especially for couples with children, is child custody. While custody orders may seem set in stone, they can be modified under certain circumstances. In Texas, a change in circumstances, such as a job relocation, can serve as the basis for requesting a modification of the custody order. Other changes in circumstances may also justify a modification if the current order no longer reflects the child’s best interests.
When orders may be modified
Under Texas law, either parent can file a petition for child custody modification at any time. If both parents agree to the changes, a proposed custody order reflecting the modifications can be submitted to the court for approval. If there is disagreement, both parents must appear before a judge to demonstrate that the changes would serve the child’s best interests. The court will only modify the order if the proposed changes meet this standard.
Some examples of changes in circumstances that may justify a custody modification include changes in marital status, job relocations, unemployment, medical conditions, abuse or neglect of the child by either parent, and substance abuse. The court considers many factors in determining whether the proposed modifications are in the child’s best interests, including the child’s needs, wishes, and relationship with each parent.

In all cases, the court will not modify the custody order unless the changes reflect the best interests of the child.
