Marital Property

All property acquired during your marriage is presumed to be community property. However, property you held prior to the marriage, received as a gift or inheritance, or any personal injury recovery (aside from wages) may be considered your separate property so long as the separate character of the property is proven to be clear and convincing evidence.

The division of property can be a source of contention between you and your spouse, and it is not uncommon for spouses to try to hide marital property. However, you can protect yourself prior to a divorce filing by creating an inventory of all property, gathering statements relating to financial holdings and obtaining copies of recent tax returns.

Other Considerations

It is important for you to understand that the decisions you make now may affect your final settlement agreement in the future. Other things to consider during your divorce planning include:

  • Existence of a premarital or postmarital agreement
  • Custodial/noncustodial parental arrangements for your children
  • Need of financial support, including child support provisions and alimony
